आखिर कब आजाद घूम पाएगी महिलाएं / When will women be able to move freely?

16 दिसंबर जब भी ये तारीख आती है तो दिमाग में 2 तस्वीर सामने आती हैं, एक भारत - पाकिस्तान युद्ध में भारत की विजय की और दूसरी 2012 में हुए भयावह निर्भया कांड की । जब भी उस बारे में सोचता हूँ तो आत्मा कांप जाती हैं। 16 दिसंबर की सर्द रात, वीरान-सी चलती सड़क और नीचे चुभती घास और भी न जाने क्या-क्या। नीचे जो चुभ रहा था, उसकी तकलीफ़ उतनी ज्यादा नहीं थी जितनी उसकी जो उसके शरीर पर चुभ रहा था। 5 फुट 5 इंच की लंबाई वाला उसका अपना शरीर भी इतना ही बड़ा लग रहा था जितना बड़ा वह सड़क । आम तौर पर एक शरीर में इतनी ही जगह होती है जितनी कि एक दूसरे शरीर के लिए काफी हो। अगर किसी लड़की की रज़ामंदी के बगैर कोई उसे छुए, तब उसे कितनी खीझ होती है, इसका अंदाज़ा लड़कियां तो लगा सकती हैं मगर पुरुष शायद नहीं लगा सकें। और अगर कोई किसी लड़की के बार-बार मना करने के बावज़ूद, उसकी ना को बिना कोई तवज़्जो दिए, बस अपनी इच्छा और मतलब के मुताबिक उसके शरीर का इस्तेमाल करे, तब उसकी खीझ और पीड़ा किस कदर बढ़ जाती होगी, ज़रा कल्पना करके देखिए।

आखिर एक बार फिर हर साल की तरह 16 दिसंबर फिर आ गई। लेकिन लेकिन शायद ही उस 16 दिसम्बर 2012 की काली स्याह रात को कोई भूल पाया होगा। दिल वालों की दिल्ली में ऐसी घटना घटी क़ी जिसने भी उस घटना को सुना और देखा या महसूस किया होगा उसका मन आक्रोश से भर गया था. लेकिन बात आई और गयी जैसी ही होकर रह गयी. आज पूरे 10 साल हो गए निर्भया केस को पर शायद ही इस देश में कुछ बदला हो । निर्भया कांड के बाद बस ऐसा लगता हैं मानो सिर्फ नाबालिग होने की उम्र 16 साल की गई हैं। सबसे लाजवाब बात निर्भया केस में सबसे खतरनाक जुर्म उसी 16 साल के लड़के ने किया था जिसको बाद में मात्र 3 साल की सज़ा के बाद छोड़ दिया गया और वो अब कहा है शायद किसी को नहीं पता पर क्या वो मानिसक रूप से बदला ? इस बात का जवाब तो शायद सरकार के पास भी नहीं होगा। उसके अलावा इस देश में कुछ नहीं बदला हैं। आज भी देश में रेप और लड़कियों से छेड़छाड़ की घटना बहुत ही आम बात हैं । 

आखिर नारी को पूजने वाला हमारा देश भारत क्या सही मायनों में नारी को पूजने का हकदार है? एक तरफ जहां भारत में कई देवियों की पूजा की जाती है तो वहीं दूसरी तरफ उसी भारत में हर घंटे 4 से ज्यादा बेटी और महिलाएं बलात्कार का शिकार हो रही हैं। साल 2012 में हुए निर्भया रेप केस से लेकर 2017 उन्नाव रेप केस, 2018 कठुआ रेप केस, कटनी रेप केस और ना जाने कितने रेप के मामलों ने देश भर के लोगों के होश उड़ा दिए। आज भी भारत में एक दिन में औसतन 87 रेप की घटना होती हैं। वहीं अगर देश की राजधानी दिल्ली की बात करें तो दिल्ली पुलिस के आंकड़ों के अनुसार राजधानी दिल्ली में एक दिन में 5.6 रेप के मामले सामने आते हैं। NCRB के ताज़ा आंकड़ों के मुताबिक़, पिछले सालों के मुकाबले रेप के मामलों में 13.23 प्रतिशत की वृद्धि हुई है।  राजस्थान (6342), मध्यप्रदेश (2947), उत्तरप्रदेश (2845) के बाद दिल्ली (1252) में रेप की घटनाएं सबसे ज़्यादा होती हैं। 

निर्भया कांड के बाद आम लोगों में जागरुकता आई है।  इसका नतीजा ये हुआ है कि ऐसे मामलों की रिपोर्टिंग बढ़ी है, लेकिन अभी भी घर के अंदर होने वाले ऐसे अपराध के मामले सामने नहीं आ रहे हैं। निर्भया का मामला सामने आने के बाद लोगों में जो एकजुटता, रोष और संवेदनशीलता देखी गई थी, अब वो ख़त्म हो चुकी है।  विडंबना ये है कि निर्भया मामला सामने आने के बाद क़ानून भी सख़्त हुए हैं, लेकिन न्याय लेने की प्रक्रिया अभी भी लंबी है। वो सवाल उठाती हैं कि ऐसे मामलों में कितने ही दोषियों को सज़ा मिल पाती है। ऐसे मामले रोकने के लिए सरकारें क्या कर रही हैं ?

भारत में अक्सर रेप से जुड़े ज्यादातर मामलों में चार्जशीट कम दर्ज होती है। इसके बाद अगर ये मामले दर्ज होकर कोर्ट पहुंचते हैं तो उनमें से दो तिहाई मामलों में लोग छूट जाते हैं और केवल एक तिहाई में सज़ा होती है। ऐसे में संदेश ये जाता है कि अपराध अगर किया भी गया तो सज़ा से बचा जा सकता है।  ऐसे में अपराध करने वालों में ये भावना प्रबल हो जाती है कि ऐसा करने में कोई ख़तरा नहीं है। आज भी समाज में रेप के मामलों को अभी भी शर्म और इ़ज़्ज़त से जोड़ कर देखा जाता है, लेकिन अब कुछ लोग आगे आकर इसकी रिपोर्ट दर्ज करा रहे हैं। साथ ही वे मानते है कि पुलिस को और प्रभावी और संवेदनशील होने की ज़रूरत है। 

आखिर कब आजाद घूम पाएगी महिलाएं 

आखिर हमारा देश ऐसा क्यों हैं जहां अपराध आसमान छू रहा हैं। हमारे यहाँ तो नारी सम्मान में जान देने तक की बात की जाती हैं। आखिर क्यों हमारा न्याय सिस्टम इतना बेकार हो गया है कि अपराधियों को जल्द से जल्द सजा नहीं दे पा रहा हैं। लेकिन ऐसा भी देखा गया है कि महिलाएं भी इसका की बार गलत इस्तेमाल करके झूठा आरोप लगाती हैं। आज भी आधे से ज्यादा रेप केस झूठे निकलते हैं। लेकिन जो सच में हैं उन पर भी सरकार या प्रशासन कोई कार्यवाही क्यों नहीं करता हैं। क्या ऐसे हम हम नारी सशक्तिकरण की बात करेंगे ? हम महिलाओं को हर क्षेत्र में आगे बढ़ने की प्रेरणा देते हैं, वहीं नारी सशक्तिकरण किस हद तक आगे बढ़ रहा और अगर आगे बढ़ रहा है तो महिलाएं क्यों अपने उपर हो रहे जुल्म की दास्तां बयां ही नहीं कर पाती, इसके कारण तो कई हो सकते हैं, पर सवाल यह उठता है कि अगर देश में हर साल हो रहे रेप और महिला अपराध की सभी घटनाएं दर्ज होने लगे तो आंकड़ा कहां से कहां तक चला जाएगा? इसका कोई अनुमान नहीं लगा सकता।

जहां भारतीय संविधान हर किसी को एक जैसा अधिकार देता है तो वहीं भारतीय कानून क्यों उस अधिकार की रक्षा करने में पीछे रह जाता है? भारत 65 % युवाओं का देश हैं। हम सबको मिलकर इस पर सोचना होगा और अपने आस पास के लोगों, दोस्तों साथियों को अगर वो गलत करते हैं तो उस पर टोकना होगा। क्योंकि अगर इस देश को सही मायनों में बदलना हैं तो हमें खुद से शुरुआत करनी होगी । सरकार को सेक्स एजुकेशन जैसे विषयों को भी 11 वीं के बाद स्कूली शिक्षा अनिवार्य कर देने के बारे में विचार करना चाहिए। इन सब कदमों के साथ ही हम रेप जैसी घटनाओं में कमी ला सकते हैं और समाज की सोच को बदल सकते हैं ।

Whenever this date comes to December 16, two pictures come to mind, one of India's victory in the Indo-Pakistan war and the other of the horrific Nirbhaya incident in 2012. Every time I think about it, my soul trembles. On a chilly night of December 16, the deserted moving road and the grass prick below. The pain of the one who was pricking below was not as much as that of the one who was pricking on his body. His own body, measuring 5 feet 5 inches in length, looked as big as the road. Generally, there is as much space in one body as it is enough for another body. If someone touches a girl without her consent, girls can guess how irritated she is, but men may not be able to guess. And imagine how much her anger and pain would increase if someone, despite her repeated refusals, used her body according to her desire and meaning, without paying any attention to her.

After all, like every year, December 16 came again. But hardly anyone has forgotten that dark night of December 16, 2012. Such an incident took place in Delhi and whoever heard and saw or felt that incident, his heart was filled with anger. But the matter came and went. Today, it has been 10 years since the Nirbhaya case, but hardly anything has changed in this country. After the Nirbhaya incident, it seems as if only a minor has been 16 years old. The most dangerous criminal in the Nirbhaya case was committed by the same 16-year-old boy who was later released after just 3 years of imprisonment he has now said that maybe no one knows, but did he change mentally? The government may not even have an answer to this. Apart from that, nothing has changed in this country. Even today, incidents of rape and molestation of girls are very common in the country. 

After all, does India, our country that worships women, truly deserve to worship women? On the one hand, where many goddesses are worshiped in India, on the other hand, more than 4 daughters and women are being raped every hour in same India. The Nirbhaya rape case in 2012 the 2017 Unnao rape case, the 2018 Kathua rape case, the Katni rape case, and many other rape cases have blown the minds of people across the country. Even today, there are an average of 87 rapes in a day in India. According to Delhi police, 5.6 cases of rape are reported in a day. According to the latest NCRB data, there has been an increase of 13.23 percent in rape cases compared to previous years.  Rajasthan (6342), Madhya Pradesh (2947), and Uttar Pradesh (2845) are followed by Delhi (1252). 

After the Nirbhaya incident, there has been awareness among ordinary people.  As a result, the reporting of such cases has increased, but still cases of such crime occurring inside the house are not being reported. The solidarity, anger, and sensitivity seen among the people after the Nirbhaya case came to light, is now over.  Ironically, the laws have also become stricter after the Nirbhaya case came to light, but the process of seeking justice is still long. She raises the question of how many culprits get punished in such cases. What are the governments doing to prevent such cases?

In India, most cases related to rape often have fewer charge sheets. After this, if these cases are registered and reach the court, then in two-thirds of them, people are acquitted and in only one-third, they are punished. In such a situation, the message goes that even if the crime is committed, punishment can be avoided.  In such a situation, the feeling becomes strong among the perpetrators that there is no danger in doing so. Even today, rape cases are still associated with shame and respect in society, but now some people are coming forward and reporting it. At the same time, they believe that the police need to be more effective and sensitive. 

When will women be able to move freely? 

After all, why is our country where crime is skyrocketing? In our country, there is talk of giving life in honor of women. After all, why has our justice system become so useless that we are not able to punish the culprits as soon as possible? But it has also been seen that women also misuse it and make false allegations. Even today, more than half of rape cases turn out to be false. But why does the government or the administration not take any action against those who are real? Is this how we talk about women's empowerment? We inspire women to move forward in every field, at the same time, to what extent women empowerment is moving forward and if women are moving forward, then why women are not able to tell the stories of atrocities against them, there can be many reasons, but the question arises that if all the incidents of rape and crime against women are registered every year in the country, then where is the figure? Where will it go? No one can guess it.

While the Indian Constitution gives everyone the same rights, why does Indian law lag behind in protecting that right? India is home to 65% of its youth. We all have to think about it together and stop the people around us, friends and colleagues if they do wrong. Because if we want to change this country in the true sense, we have to start with ourselves. The government should also consider making subjects like sex education compulsory after class 11. With all these steps, we can reduce incidents like rape and change the mindset of society.
